Compensation may be available for earnings lost during a crime-related disability period, or to attend funeral services, medical and mental health care appointments, and criminal justice proceedings.

Once your application is approved, we will work with you to determine your eligible loss of earnings.

What Loss of Earnings Are Covered?

Loss of earnings may be paid to a victim who misses work for:

  • A crime-related disability period
  • Attending medical or mental health care appointments
  • Participation in criminal justice proceedings

Loss of earnings may be paid to a claimant who misses work for:

  • Bereavement leave taken in connection with a victim’s death
  • Attending mental health care appointments or victim’s medical appointments
  • Participation in criminal justice proceedings

Loss of earnings are based on verification of your net salary at the time of the crime.

Who May Receive Compensation?

Victims and claimants who miss work for the reasons stated above.   

What is a Disability Period?

A disability period is the length of time a victim has a medically determinable physical or mental impairment that causes the victim to be unable to perform their work as a direct result of the crime. For a victim under 18, the disability period means the length of time the victim has a medically determinable physical or mental impairment, or a combination of impairments, that causes marked and severe functional limitations as a direct result of the crime. A disability period must be determined by a Medical Doctor (MD), Doctor of Osteopathy (DO), or the OAG.

Note: For loss of earnings, a disability period can only be determined by an MD or DO. You may receive mental health care services from an approved provider who is not an MD or DO; however, such providers are not eligible to determine your disability period.

Compensation Limits

Loss of earnings compensation is limited to $700 per week for crimes after July 14, 2016. For dates of crime before this, other limits will apply.

CVC is the last source of payment by law. All other readily available resources must pay before any payment by the program.
